NO-FAULT DIVORCE
Florida has been a no-fault divorce state for many years. No-fault divorce means that there are no grounds in the state of Florida and the requirement to be able to file for divorce is that you have lived in the state of Florida for at least six (6) months prior to your filing for divorce. Issues that may still remain to be litigated in court are custody, support both spouse and child, visitation, payment of health care, daycare, splitting of assets and of debts. This is what can make an uncontested divorce, where the issues have been resolved and/or there are no children or any issues to argue about, into a contested divorce where the parties are arguing over children, the assets or debts, alimony and other issues.

DEFINITIONS
The word dissolution, basically means divorce. The word alimony means funds to be received by one spouse from the other as a result of the length of a marriage, the income and assets that each party may have, the health of the parties and related issues that may impact on alimony. Child support means that both parties are required to pay child support. However, the party that has the children is normally not paying an actual dollar amount, since caring for children is also consider child support. The non-residential parent is usually the one who pays child support. Child support is based upon specific child support guidelines mandated by Florida state statutes. It normally results in a prorata share based on net income, assets and related issues. In addition, per child support guidelines, one party may have to pay a percentage share of daycare and healthcare and child support guidelines are normally based on the earning ability of both parties and the percentage of that earning ability that each party may have. Florida is an equitable distribution state. That means that the court will consider contributions to the marital relationship whether monetary or not. For example, if one party is the person that cares for the children and keeps the household and the other party is the one that goes out and makes a living by being employed, the court may consider the contributions of both of those people to the marriage as relatively equal. Issues that may be considered by a court of equitable distribution are title of assets, whether the assets have been part of the marriage, length of the marriage, value of the assets of each party and related issues relationship contributions by each party to marital assets.

A pre or postnuptial agreement, is an agreement entered into by the parties agreeing to issues of child support, alimony, custody, equitable distribution and related issues prior to the marriage, prenuptial or subsequent to the marriage, postnuptial. A The marital rights agreement is an agreement or contract between the parties. All of the issues stated above are agreed to by the parties. The agreement usually results in an uncontested divorce.

Jerome Siegel is a Florida Supreme Court, certified family and circuit civil mediator. Mediation means that an impartial, non-biased, third party will attempt to resolved the issues in a divorce or family matter and, in the event said issues are resolve successfully, a mediation agreement will be entered into which will remove the need for filing litigation and/or will settle any issues in the litigation. Mediation is a very important process in that it can be very cost effective; greatly reduce any anxiety, fees, and time that family litigation may involve.
